The purchase of any travel services given by Mountainiax (here after referred to as”Mountainiax, “We,” “Us,” or “Our”) constitutes a contractual agreement between Mountainiax (‘First Party’) and Client (hereinafter referred as ‘You’) (‘Second Party’). Both Parties are hereinafter referred to as (‘Parties’). Booking of services of Mountainiax represents your outright consent of the Terms & Conditions set out herein. These Terms &Conditions shall be mandatory on you and all the travel companions booked by you. Please read our Terms & Conditions carefully before purchasing our travel service. In case you do not agree to Terms and Conditions of Mountainiax, no information from or travel services will be provided to you.

Trekking and other adventure activities in the Himalayan region bring an inherent peril to life and property of both Parties. The unpredictable weather conditions, risk of injuries and different life-threatening conditions are beyond Mountainiax’s control. Mountainiax does its best to minimize all types of threats, perils, and hazards to the best of our ability (within financial constraints), yet there are chances of disasters, mishaps, and unfortunate events.

For the same reasons, you must acknowledge these Terms & Conditions. Therefore, please ensure that you read thoroughly and understand these terms before your booking confirmations.

  • HEALTH AND PHYSICAL FITNESS REQUIREMENTS

Mountainiax expects from travelers booking our services to be in good health and physically fit. Travelers, with any medical problems/ailment/disorder must disclose it to us well before making bookings. If you suffer from heart, chest, severe muscular, bronchial disorders, asthma, or have high blood pressure, you are strongly recommended not to participate in treks. Our treks/trips generally take place in remote Himalayan regions where there is very little or no mobile connectivity and even no access to medical or health services for serious health emergencies. In these situations, at the time of a health emergency, evacuation can be delayed. All the medical and evacuation expenses will be the participant’s responsibility.

  • DELAY OR CHANGE IN ITINERARY

Mountainiax will not be obliged to refund or compensate if the trek got canceled due to any natural disaster, national emergency, health emergency, terrorist activity, war, riots, or any other unforeseen circumstances. If the trek gets delayed or there is any change in the trek route or travel route due to sudden and unexpected weather conditions or any inevitable situation, trekkers will not be entitled to any refund or compensation.

  • EARLY TERMINATION OF A TREK

If in case the treks finish before its schedule day or date; or trekker has to end trek due to some health or personal reasons, Mountainiax does not offer any refunds for remaining days of the trek. Our costs will remain the same as we are liable to pay our local porters and guides.

  • DOCUMENTS AND IDENTIFICATION CARDS

All travelers are required to carry valid documents and Identity cards with them all the time, as these documents will be required to obtain necessary approval for the treks.

  • Indian – Adhaar Card, Driving License, and any other Government recognised document.
  • Foreigners – Passport and Visa.

We will not be responsible for delays caused due to incomplete or lack of essential documents.

  • AUTHORITY OF THE TREK LEADER

At all times during the tour/trek, the decision of the Mountainiax Tour/Trek leader or any representative of Mountainiax will be final on all matters likely to affect the safety and well-being of the travelers and trekkers. In the case on any non-agreement with a decision made by our trek leader, obstruct or interfere with the decision taken for the well-being of the fellow trekkers, then trek leader reserves the right to terminate your tour/trek and ask you to leave the tour/trek immediately, with no right to claim any refund.

  • GRIEVANCES

If you have any grievances about your trip, trek, trek leader, or fellow trekkers, you must reach out to our local representative at the earliest, who will address your grievances and initiate appropriate action. If still, you feel that your complaints have not been dealt with properly, you must contact us in writing within 30 days of the end of your trip.

  • ACCEPTANCE OF TERMS & CONDITION

Once you have made a payment for any of our travel services, it will be taken for granted that you accepted our terms and conditions.
